PengwinPlays.com ("the site") is run by Pengwin. By using the site, its pages, its data files or its Discord, you agree to these terms. If you don't agree, please don't use the site.
1. Research tools, not advice
Everything on the site, including BreakPoint, WeatherMan and any other screener, alert, price, forecast, statistic or comment, is for information and research only. It is not financial, investment, legal or tax advice, and it is not a recommendation to buy or sell anything. The tools never tell you what to trade. Every decision you make is your own.
2. No guarantees
The tools are personal, experimental projects. Data can be late, wrong, incomplete or missing. Alerts can fire when they shouldn't, or not fire when they should. Past results, including every "right", "wrong", "underdog won" or "came back" shown on the site, do not predict future results. The site is provided "as is" and "as available", without warranties of any kind.
3. Trading risk
Trading on prediction markets can lose money, including all of it. Only trade what you can afford to lose. You are responsible for following the rules of any exchange you use and the laws where you live.
4. Limitation of liability
To the fullest extent allowed by law, Pengwin and PengwinPlays are not liable for any losses or damages, direct or indirect, that come from using or relying on the site, its tools, its data or its Discord, including trading losses. If the law doesn't allow some of this limit, the limit applies as far as it's allowed.
5. Not affiliated
PengwinPlays is independent. It is not affiliated with, endorsed by or sponsored by Kalshi, the National Weather Service, the ATP, WTA, ITF, MLB, NFL, NBA or any other organization named on the site. Names and data belong to their owners. Links to other sites are for convenience; we don't control them.
6. Using the site fairly
- Personal use of the pages and data is welcome.
- Don't overload the site or data.pengwinplays.com with automated requests, try to break or get around its security, or use it for anything illegal.
- Don't resell or republish the site's data or alerts as your own product without written permission.
7. Sign-ups, ideas and the Discord
If you join the email list or send a bot idea, see the Privacy page for how that's handled. Ideas you send can be used to build tools without payment or credit owed, though we'll try to give a shout-out. The Discord has its own rules posted there; be respectful.
8. Paid products
Paid products, like Pebble, will have their own terms that you'll agree to before buying. Those terms will cover billing, your Kalshi key and your account. These terms cover the free site.
9. Changes
These terms can change. The date at the top shows the latest version. Using the site after a change means you accept the new terms.
